Terms and Conditions 

1. Scope

These Terms and Conditions of Sale ("Terms") govern, without restriction or reservation, all sales of products made through the website nereisocean.com between:

The Seller:
NEREÏS OCEAN, a simplified joint-stock company (SAS) with a share capital of €22,293, registered with the Trade and Companies Register (RCS) of Quimper under number 989 436 084, with its registered office located at 3 Rue du Crénoc, 29160 Crozon, France,

and

The Buyer or Customer, whether acting as a private consumer or as a business customer.

These Terms define the rights and obligations of both parties in relation to the sale of products.

By placing an order on this website, the Customer acknowledges having read and accepted these Terms without reservation. The version of the Terms applicable to an order is the version in force at the time the order is placed.

Nereïs Ocean reserves the right to amend these Terms at any time. Any changes shall apply only to orders placed after the updated Terms have been published.


2. Products

The products offered for sale are presented on the Seller's website. The essential characteristics of each product are described on the relevant product page.

Product images and photographs are provided for illustrative purposes only. While every effort is made to ensure they accurately represent the products, slight variations may occur, particularly for pre-order products or handcrafted items.


3. Prices

Unless otherwise stated, all prices displayed on the website are shown in euros (€) and include all applicable taxes (VAT) for deliveries within mainland France.

Shipping costs are calculated separately and displayed before the Customer confirms their order.

French Overseas Territories (DROM-COM)

For customers located in French overseas territories and collectivities (DROM-COM), product prices are displayed exclusive of French VAT once the delivery destination has been selected.

Any taxes, customs duties, import VAT, Octroi de Mer, or other charges imposed by the destination territory remain the sole responsibility of the Customer. Nereïs Ocean has no control over these charges and cannot estimate or guarantee the total amount that may be payable to local customs or tax authorities.

International Orders

For orders shipped outside France, including countries outside the European Union, the Customer may be required to pay customs duties, import taxes, VAT/GST, or other local charges imposed by the destination country. These charges are not included in the purchase price unless expressly stated and remain entirely the Customer's responsibility.

Nereïs Ocean reserves the right to modify its prices at any time. However, products will always be invoiced at the price displayed on the website at the time the order is confirmed.


4. Orders

Orders are placed directly through the Seller's website.

A sales contract is deemed concluded once full payment has been successfully received. The Customer will receive an order confirmation by email.

The Seller securely stores all orders and order confirmations on a durable medium in accordance with applicable French law. Electronic records maintained by the Seller shall constitute valid evidence of communications, orders, payments and transactions between the parties.

Placing an order through the website constitutes full acceptance of these Terms. These Terms prevail over any general or specific purchasing conditions that may be issued by the Customer.

Customers must be at least 18 years of age, legally capable of entering into a binding contract, or have obtained the consent of a parent or legal guardian to place an order.

 

5. Payment

Payment may be made online using the secure payment methods offered through Shopify, or by bank transfer or cheque where available.

Nereïs Ocean does not store or have access to Customers' banking or payment card details.

Orders will only be processed once full payment has been received.


6. Shipping & Delivery

Unless otherwise specified, products are dispatched within an estimated maximum timeframe of three (3) weeks, excluding pre-orders and made-to-order products.

The Customer will receive a shipping confirmation email once the order has been dispatched.

Delivery times vary depending on the destination and may be significantly longer for international shipments and deliveries to French overseas territories.

Pre-orders and Made-to-Order Products

Certain products may be offered on a pre-order or made-to-order basis. In such cases, the estimated dispatch timeframe is clearly indicated on the relevant product page and may exceed the standard dispatch period.

By placing an order for such products, the Customer acknowledges and accepts these extended production and shipping timeframes.

Delivery dates are provided as estimates only. Nereïs Ocean cannot be held responsible for delays caused by shipping carriers, customs clearance procedures, weather conditions, industrial action, force majeure, or any other circumstances beyond its reasonable control.


7. Right of Withdrawal

Customers within the European Union

In accordance with applicable European consumer protection legislation, Customers whose orders are delivered within the European Union have the right to withdraw from their purchase within 14 days of receiving their order, without providing any reason.

To exercise this right, the Customer must notify Nereïs Ocean of their decision within the withdrawal period and return the product in its original condition.

Returned products must be unused, complete, in their original packaging, and accompanied by proof of purchase.

Unless otherwise required by law, return shipping costs are the responsibility of the Customer.

Upon acceptance of the return, the Customer will be refunded the purchase price of the returned product using the original payment method.

Customers Outside the European Union

For orders delivered outside the European Union, including Australia, New Zealand, the United States, Canada and other international destinations, Nereïs Ocean voluntarily offers a 14-day return policy from the date of delivery.

Products must be returned unused, complete, in their original packaging, with all original accessories and documentation, and accompanied by proof of purchase.

Return shipping costs, customs duties, import taxes and any associated charges remain the responsibility of the Customer unless the returned product is defective, damaged or incorrect.


8. Returns

Returned products must be sent back in their original condition, complete and suitable for resale.

Customers may be asked to provide proof of purchase, such as an invoice or order number.

Unless otherwise stated, returns are accepted within 14 days of delivery. Nereïs Ocean may occasionally offer extended return periods during specific promotional events (for example, the Christmas holiday season). Any such exceptions will be communicated to Customers in advance.

Unless otherwise specified, return shipping costs are borne by the Customer.

Items returned without prior authorisation may be refused.


9. Legal Warranty

Products sold by Nereïs Ocean benefit from the legal warranties provided under applicable French law, including the legal warranty of conformity and the warranty against hidden defects.

If a product is found to be defective or non-conforming, the Customer may request either repair or replacement.

However, if the Customer's preferred remedy would impose a clearly disproportionate cost on the Seller compared with the alternative remedy, Nereïs Ocean reserves the right to choose the most appropriate solution.

Where repair and replacement are impossible or cannot reasonably be carried out, the Customer may return the product and receive a refund of the purchase price, in accordance with applicable law.

 

10. Liability

DeepFoil is a water sports device intended for responsible users with adequate swimming ability and suitable physical fitness.

It is not a lifesaving device, should not be used as a flotation aid, and is not suitable for children.

The use of DeepFoil requires the ability to swim confidently and, ideally, a basic understanding of freediving or underwater swimming techniques.

The user is solely responsible for their own safety and must always be able to return to the surface independently without assistance.

DeepFoil should never be used alone. Users are strongly advised to dive with a buddy or under appropriate supervision at all times.

Before each use, users should assess weather, water conditions, currents, visibility, and any other environmental factors that may affect their safety. DeepFoil should not be used in hazardous areas, strong currents, deep water beyond the user's abilities, or locations where appropriate supervision is unavailable.

Users should also take particular care to equalise ear pressure correctly during dives, whether in the ocean or in a swimming pool, and avoid descending beyond their level of training or experience.

To the fullest extent permitted by applicable law, Nereïs Ocean shall not be liable for any injury, accident, damage or loss resulting from improper, unsafe or negligent use of the product, failure to follow safety recommendations, or use outside its intended purpose.

Nereïs Ocean is registered with the French National Register of Producers under the following Unique Identification Number (IDU): FR472691_13RAJI.


11. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of France.

In the event of any dispute relating to the interpretation or performance of these Terms, the parties agree to seek an amicable resolution before commencing legal proceedings.

Consumer Mediation

In accordance with Articles L.612-1 and following of the French Consumer Code, consumers are entitled to use a consumer mediation service free of charge for the amicable resolution of disputes.

Consumers may also submit complaints through the European Online Dispute Resolution (ODR) platform:

If no amicable settlement can be reached, consumers may bring proceedings before the competent court in accordance with applicable law.

Business Customers

Any dispute arising between Nereïs Ocean and a business customer that cannot be resolved amicably shall fall within the exclusive jurisdiction of the Commercial Court of Quimper (France), including in cases involving multiple defendants or third-party claims.


12. Personal Data

Personal information collected through the website is used solely for processing orders, managing customer relationships, and fulfilling legal obligations.

Nereïs Ocean does not sell or share Customers' personal data with third parties for marketing purposes.

Customers have the right to access, correct, update, or request the deletion of their personal data in accordance with applicable data protection legislation. Further information is available in our Privacy Policy.
